Business terms and conditions for families hiring Au pair or Au pair plus
1. The agency provides an introduction between the family and the au pair. Whilst the agency will make every reasonable effort to verify the integrity and suitability of an au pair. The agency cannot be held responsible for any dishonest or malicious act by the au pair nor held responsible for the accuracy of the information provided by the au pair.
2. The au pair is not employed by the agency, but by the family. The agency shall not be liable under any circumstances for any loss, damage or expense incurred by the family or au pair, prior to, during or subsequent to the engagement of an applicant.
3. The client (family) shall pay the full placement fee before the commencement of employment of an au pair. No travel arrangements can be made until the full fee is received by the agency. Payments received after the au pair has arrived are subject to a 25% surcharge.
4. If the family employs an au pair who is already in the U.K., and the placement fee is not received, the agency will remove the au pair from the family.
5. For “Long term au pair” the agency offers a 30 days probationary period beginning the day the au pair commences work with the family. The probationary period is only valid if the full placement fee has been received by the agency.
6. In case of early termination (by either party) within 0-30 day’s probationary period the agency will offer an alternative au pair free of charge or a 50% refund will be made.
7. Refunds/replacements can only be made to clients who have paid the full placement fee before commencement of placement and where we have received written notification within 48 hours stating that the employment has been terminated.
8. After the 30 days probationary period has elapsed, the agency’s obligations have been fulfilled and no replacement or refund will be made.
9. Should the au pair cancel or fail to arrive the agency will make it a priority to find a suitable replacement. If it is not possible then a refund will be made less £65.00/98.00EUR for the administration cost.
10. The agency does not provide a refund or replacement of au pair for “Short term au pair” or “summer au pair”.
11. The agency cannot be held responsible for early termination by either party.
12. Should the au Pair stay with the host family for a longer period than originally agreed upon, a further fee will become payable dependant on the duration of the subsequent stay.
13. If either party wishes to terminate the contract, two weeks' notice must be given. During this time the au pair should be allowed to continue living with the family and should carry on their normal duties and receive pocket money, as usual. The au pair must not be made to leave the family home immediately unless criminal activity has taken place in which case the agency and police must be informed.
14. Should a Client effect any form of introduction, direct or indirect, of an applicant to a third Party, or pass on any details resulting in permanent, short-term, full or part-time employment, the Client will be responsible for the full introductory fees in accordance with the current scale of charges.
15. The agency cannot be held responsible for the accuracy of information provided by the au pair. All information provided by the family and au Pair is strictly confidential.
16. The terms stated on the application forms will form a contract between the family and the au pair. The terms and conditions of the Bohemia King Limited. will be deemed as accepted by the family by completion of the registration form.
17. The family should understand that the au pair arrangement is a cultural exchange and not a contract of work. Au pairs should be treated as a member of the family and not as hired help. It is the families' responsibility to show initiative, to integrate the au pair into their family life, help with English learning and any other difficulties that may arise.
18. The family should regularly communicate with their au pair to make sure there are no problems. The agency is happy to assist at any time with such communications.
19. It is the responsibility of the host family to collect the au pair on arrival in this country and departure from this country, or cover their travel expenses to and from the airport/coach station.
20. A week’s paid holiday shall be credited by the host family to the au pair after completion of six month’s living with family.
21. The agency has the right to remove the au pair from the family failing to follow the guidelines or terms and conditions or for giving false information when registering. In this case no refund will be made.
22. The family we will not employ any applicant registered with Bohemia King Limited introduced to them direct or indirect by Third Party. In this case the family will be responsible for the full introductory fees in accordance with the current scale of charges.
23. We confirm that we have read all written materials provided by the au pair agency and that we will follow these guidelines.
